Crypto Regulation Keeps Moving After CLARITY Stalls - but the New Rules May Be Easier to Reverse
The Senate’s failure to advance the CLARITY Act has not stopped U.S. digital-asset policy from changing. Bitwise CIO Matt Hougan argues that regulators have moved more quickly in several areas since the September 15 vote, particularly tokenized equities, token buybacks and stablecoin-related business models. This argument is supported by subsequent SEC action: the Commission created a temporary framework for limited onchain trading of tokenized U.S. stocks, while its Corporation Finance staff issued new buybacks guidance on functional decentralized networks. The tradeoff is durability. Agency exemptions and staff interpretations can move faster than Congress, but they do not provide legislative permanence.
